Agreement to Terms

By accessing adm.media or engaging All Digital Magic ("ADM", "we", "us") for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use this website or our services.

Services

All Digital Magic provides the following services:

• Web Services — domain registration, website design and development, e-commerce, web portals, and managed hosting
• Music Production — original composition, mixing, mastering, beat production, sound design, and vocal production

All services are provided subject to a separate written agreement or proposal accepted by both parties. These Terms govern the general use of adm.media and provide baseline conditions for all engagements.

Web Services Terms

Project Agreements

All web design and development projects begin with a written scope of work agreed upon by both parties. Work begins only after a deposit has been received as specified in the project proposal.

Client Responsibilities

Clients are responsible for providing accurate content, timely feedback, and any third-party credentials (domain registrar, hosting, payment gateway) required to complete the project. Delays caused by late client feedback may affect delivery timelines.

Intellectual Property

Upon full payment, clients receive full ownership of the website design, code, and content created specifically for their project. ADM retains the right to display completed work in its portfolio unless the client requests otherwise in writing.

Hosting

Managed hosting services are provided on a monthly or annual basis. ADM reserves the right to suspend hosting for non-payment after 14 days written notice. Clients are responsible for maintaining backups of their own data.

Warranties

We warrant that websites will function as specified at delivery. We do not warrant uninterrupted service, compatibility with all browsers beyond those specified in the project scope, or results from SEO work.

Music Production Terms

Licensing

Music streamed on adm.media is the exclusive property of All Digital Magic and the respective artists. Streaming is provided for demonstration and evaluation purposes only. No track may be downloaded, reproduced, broadcast, or used commercially without a written licence agreement.

Commissioned Work

Commissioned music productions are governed by individual agreements specifying deliverables, timelines, payment terms, and ownership rights. Unless otherwise agreed in writing, ADM retains the master recording rights. Clients receive a licence to use the commissioned work for the agreed purpose.

Beats and Instrumentals

Non-exclusive beat licences allow use for one project as specified. Exclusive licences transfer full rights to the purchaser upon payment. All licensing terms are detailed in individual licence agreements.

Payment Terms

• All prices are in US Dollars unless otherwise stated
• Web project deposits are non-refundable once work has commenced
• Final deliverables are released upon receipt of final payment
• Invoices unpaid after 30 days may incur a late fee of 1.5% per month
• Hosting fees are due in advance; no refunds for partial months

Limitation of Liability

All Digital Magic's liability for any claim arising from our services is limited to the total amount paid by the client for the specific service giving rise to the claim. We are not liable for indirect, incidental, or consequential damages including lost profits, lost data, or business interruption.

Acceptable Use

You agree not to use adm.media or our services to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Transmit malicious code, spam, or unsolicited communications
• Attempt to gain unauthorised access to our systems
• Reproduce, distribute, or commercially exploit any music on this site without a licence

Governing Law

These Terms are governed by the laws of the State of Florida, USA. Any disputes shall be resolved in the courts of Citrus County, Florida, unless otherwise agreed in writing.

Changes to These Terms

We reserve the right to update these Terms at any time. Changes are effective immediately upon posting. Continued use of our services after changes constitutes acceptance of the updated Terms.
